These Terms of Service ("Terms") form a binding agreement between you and Drift Hockey LLC, a Pennsylvania limited liability company ("Drift Hockey," "we," "us," or "our"), and govern your access to and use of the Drift Hockey mobile and web applications, websites, and related services (collectively, the "Service"). By creating an account, tapping "I agree," or otherwise using the Service, you accept these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, do not use the Service.
Electronic records & signatures (E-SIGN Act). By accepting these Terms electronically, you consent to enter into agreements and receive records, notices, and disclosures from Drift Hockey LLC in electronic form, and agree that your electronic acceptance has the same legal effect as a handwritten signature under the federal E-SIGN Act (15 U.S.C. § 7001) and similar state laws. You may withdraw this consent only by closing your account; you may obtain a paper copy of any record by emailing legal@drifthockey.com.
PLEASE READ — Mandatory Arbitration & Class-Action Waiver
Section 17 requires you and Drift Hockey to resolve most disputes through individual binding arbitration administered by the American Arbitration Association (AAA) under the AAA Consumer Arbitration Rules, and waives your right to a jury trial and to participate in class actions. You may opt out of Section 17 by emailing legal@drifthockey.com within 30 days of first accepting these Terms.
1. Definitions & Roles
- User — anyone who accesses the Service with an account, including coaches, parents, players, and managed minors.
- Team Admin — a coach, manager, or owner with permissions to manage a team's roster, schedule, content, or settings.
- Club Owner — the User who controls a club's billing, ownership, and member roles. A Club Owner is bound by these Terms on behalf of the club.
- Roster Member — a person added to a team's roster by a Team Admin (with or without an account of their own).
- Player Data — information about a Roster Member entered by a Team Admin (e.g., jersey number, position, guardian contact).
- User Content — anything you upload, post, or transmit through the Service (messages, photos, video, drills, notes, etc.).
2. Eligibility & Account Types
You must be at least 13 years old to create your own account. Children under 13 may use the Service only through a "managed child account" created and supervised by a verified parent or legal guardian in accordance with our Children's Privacy Policy and the U.S. Children's Online Privacy Protection Act (COPPA).
If you accept these Terms on behalf of a club, team, or other organization, you represent that you have authority to bind that organization, and "you" includes that organization. Team Admins who enter Player Data about another person represent they have authority to do so (e.g., as the person's coach, parent, or guardian).
3. Your Account
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us at safety@drifthockey.com immediately if you suspect unauthorized access. You must provide accurate information and keep it current. We may refuse, suspend, or terminate accounts that contain false information, impersonate others, or are used to circumvent these Terms.
4. Acceptable Use & Zero-Tolerance Policy
Drift Hockey enforces a zero-tolerance policy for objectionable content and abusive behavior, as required by Apple App Store Guideline 1.2 and Google Play Developer Program Policies. You agree not to upload, post, transmit, or otherwise make available any content or conduct that:
- is unlawful, defamatory, threatening, harassing, hateful, or discriminatory;
- sexualizes minors in any way, or constitutes child sexual abuse material (CSAM) — including AI-generated, drawn, or modified depictions;
- promotes self-harm, suicide, terrorism, or violence toward any person or group;
- contains spam, scams, phishing, malware, or unauthorized commercial solicitations;
- doxxes, impersonates, or invades the privacy of any person;
- infringes any patent, trademark, trade secret, copyright, or other intellectual-property right — including, without limitation, broadcast, televised, or league-produced game footage (NHL, AHL, ECHL, NCAA, USA Hockey, Hockey Canada, junior leagues, high-school athletic associations, and similar), commercial coaching or training videos, paid subscription content (e.g., Hudl, InStat, ESPN+), and copyrighted music tracks, in each case absent a license or other authorization;
- circumvents safety features, rate limits, blocking, or moderation tools;
- attempts to access another account, scrape data, or reverse engineer the Service.
Violations may result in immediate content removal, account suspension, permanent termination, and reporting to law enforcement or NCMEC where required by law.
5. Automated Content Filtering
To enforce Section 4, the Service uses automated keyword and pattern filtering on messages and other user content. Content matching prohibited patterns may be blocked from being sent and logged for safety review. By using the Service, you consent to this automated processing for safety, integrity, and legal-compliance purposes.
6. Reporting, Blocking & Moderation
Every message in Drift Hockey can be reported via the in-app "Report" action. Our safety team reviews reports within 24 hours and may dismiss the report, warn the user, remove the content, suspend the account, or permanently terminate the account. You may also block any other user; blocked users cannot send you direct messages and their group messages are hidden from your view.
To report a safety concern outside the app, email safety@drifthockey.com. Severe violations (CSAM, credible threats of violence, active self-harm crises) are escalated immediately and may be reported to law enforcement and NCMEC.
6a. EU Digital Services Act & UK Online Safety Act
For users accessing the Service from the European Union or the United Kingdom, the following additional commitments apply, consistent with the EU Digital Services Act (Regulation (EU) 2022/2065, "DSA") and the UK Online Safety Act 2023 ("OSA"):
- Single point of contact (DSA Art. 11–12). For authorities and for users submitting illegal-content notices, our designated contact is safety@drifthockey.com. Communications may be made in English.
- Notice-and-action mechanism (DSA Art. 16). Any person may submit a notice of allegedly illegal content via the in-app Report action or by emailing the address above. Notices should identify the content, its location, the legal basis for the claim, the notifier's contact details, and a good-faith statement that the information is accurate.
- Statement of reasons (DSA Art. 17). When we remove content, restrict its visibility, suspend or terminate an account, or suspend or terminate the provision of the Service to a user, we will provide the affected user with a clear and specific statement of reasons by in-app notice and email, including the legal or contractual basis for the action and the available redress options.
- Internal complaint handling (DSA Art. 20). Affected users may appeal any moderation decision for six (6) months by emailing safety@drifthockey.com with subject "Appeal." Appeals are reviewed by qualified human reviewers who did not make the original decision. We acknowledge appeals within 5 business days and aim to resolve them within 30 days.
- Out-of-court dispute settlement (DSA Art. 21). Without prejudice to your right to bring proceedings before a court, you may select any certified out-of-court dispute-settlement body in your Member State. We will engage in good faith with such proceedings.
- UK Online Safety Act. We conduct periodic children's-access and illegal-content risk assessments appropriate to the limited youth-managed-account features we offer, maintain the safety controls described in Section 37, and operate the reporting and complaints flows above as our user-empowerment and complaints duties under the OSA. Ofcom and other competent authorities may contact us at legal@drifthockey.com.
7. Suspension & Termination
We may suspend or terminate your account, with or without notice, if you violate these Terms or our Community Guidelines, if your account creates security or legal risk, or if required by law. Suspended users will see a suspension notice on next sign-in and may appeal by emailing safety@drifthockey.com. You may delete your account at any time from Profile → Account → Delete Account; deletion is subject to the retention rules described in our Privacy Policy.
8. User Content & License
You retain ownership of your User Content. You grant Drift Hockey a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting and delivery), display, and transmit your User Content solely to operate, secure, and improve the Service for you and the teams, clubs, and organizations to which you belong. This license ends when you or we delete the content, except for backups retained for a reasonable period and anonymized analytics.
You represent that you own or have the necessary rights to your User Content and that it does not violate Section 4 or any third-party right.
Passive host; no duty to monitor. Drift Hockey LLCacts as a passive host of User Content. We do not pre-screen, endorse, sponsor, verify, or adopt User Content, and we have no obligation to monitor it, consistent with 47 U.S.C. § 230(c) and 17 U.S.C. § 512(c) and (m). We may, but are not required to, review, refuse, remove, or disable access to any User Content at any time, in our sole discretion, with or without notice. Any such action is taken in good faith and does not waive or limit any statutory protection available to us.
9. Subscriptions, Auto-Renewal & Refunds
Some features are available only with a paid subscription. Subscriptions are billed through Stripe (web) or the applicable mobile app store. Prices, billing intervals, and seat counts are shown at checkout and in your billing settings.
- Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price until canceled.
- Cancellation. You may cancel any time from your billing settings; cancellation takes effect at the end of the current paid period and you retain access through that period. We do not provide pro-rata refunds for partial periods.
- No refunds. Except where required by law (e.g., EU/UK statutory rights), subscription payments to Drift Hockey are non-refundable. Bookings made through Drift Sessions are covered in Section 9a.
- Price changes. We will give you at least 30 days' notice of any price increase before it applies to your renewal. If you do not agree, you may cancel before the new price takes effect.
- Mobile-store purchases. Subscriptions purchased through the Apple App Store or Google Play are governed by that store's refund and cancellation policy.
- Failed payments. If a payment fails, we may suspend access until payment is brought current.
- Chargebacks. Initiating a chargeback or payment dispute without first contacting support@drifthockey.com may result in suspension of the account and any clubs it owns pending resolution. Drift Hockey reserves the right to recover associated bank or processor fees.
9a. Drift Sessions Bookings
Drift Sessions lets organizations (such as camps, clinics, coaches, and rinks) list programs and take registrations and payments from families. When you book through Drift Sessions, you are buying from the organization, not from Drift Hockey. The organization is the seller and is responsible for the program, its description, its price, and its refund and cancellation policy. Drift Hockey provides the software and does not run programs.
- Booking fee. Drift Hockey adds a booking fee of 2% of the price, subject to a $1 minimum and $10 maximum per transaction, to each paid card registration. The family pays the fee, and it is shown in the total before checkout.
- Payments and payouts. Payments are processed by Stripe and paid out to the organization's connected Stripe account. Stripe's standard card processing fees are deducted from the organization's payout. Organizations must accept Stripe's Connected Account Agreement.
- Refunds and cancellations. Each organization sets its own refund and cancellation policy, which is shown on its program page. When an organization refunds a booking, the family receives the refunded amount and the matching portion of the Drift booking fee back. Stripe does not return its card processing fees on refunds, and those fees are not recovered by the organization.
- Questions and disputes. Families should contact the organization first about a program, a refund, or a charge. The organization handles refund requests and responds to chargebacks on its payments. Drift Hockey provides the booking and payment records needed to resolve them, and may step in where a problem is caused by fraud or by an error in the Service. You can reach us at support@drifthockey.com.
- Organization responsibilities. Organizations must describe programs accurately, honor their posted refund policy, deliver what they sell, and comply with laws that apply to them, including youth-program, waiver, and consumer-protection laws. Organizations are responsible for the questions they add to registration forms. If they ask for health or other sensitive information, they must ask only for what they need to run the program, keep answers optional where possible, and use them only for that program and in line with applicable law.
10. Third-Party Services
The Service relies on sub-processors (e.g., Supabase, Mux, Resend, Stripe, Apple Push, Firebase Cloud Messaging, Sentry, Google Maps). Each is bound by data-protection terms. The current list and their roles are detailed in our Privacy Policy. Your use of third-party services accessed through the Service (for example, calendar exports or map directions) is also subject to those providers' terms.
11. Intellectual Property
The Service, including its software, design, trademarks, and content (excluding User Content), is owned by Drift Hockey LLC or its licensors and is protected by U.S. and international intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. All other rights are reserved.
12. DMCA & Copyright
If you believe content on the Service infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c)(3) to our designated agent. See our DMCA Policy for the full procedure, counter-notice rights, and our repeat-infringer policy.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIFT HOCKEY LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) USD $100. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, IN WHICH CASE THEY APPLY TO THE FULLEST EXTENT PERMITTED.
15. Indemnification
You agree to defend, indemnify, and hold harmless Drift Hockey LLC and its affiliates from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your User Content or Player Data you entered, (c) your violation of these Terms, or (d) your violation of any third-party right.
16. Governing Law & Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict-of-laws rules. Subject to Section 17, the state and federal courts located in Delaware County, Pennsylvania have exclusive jurisdiction over any dispute not subject to arbitration, and you consent to personal jurisdiction in those courts.
17. Binding Arbitration & Class-Action Waiver
Please read carefully — this affects your legal rights.
Informal Notice of Dispute. Before initiating arbitration, you and Drift Hockey agree to first send a written Notice of Dispute describing the nature and basis of the claim and the relief sought. Send notices to Drift Hockey at legal@drifthockey.com with subject "Notice of Dispute"; we will send notices to the email on your account. Neither party may begin arbitration until 60 days after the Notice is received. Any applicable statute of limitations and AAA filing-fee deadline are tolled during that period.
Scope. Except for (a) small-claims court actions brought on an individual basis, (b) claims for injunctive or other equitable relief related to intellectual property, trade secrets, defamation, or violations of the Computer Fraud and Abuse Act, and (c) where prohibited by applicable law, you and Drift Hockey agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service through final and binding individual arbitration administered by the American Arbitration Association (AAA) under the AAA Consumer Arbitration Rules then in effect. The seat of arbitration is Delaware County, Pennsylvania; you may elect to participate by phone, video, or in-person hearing as the Rules allow. The arbitrator, not any court, will decide all issues of arbitrability, except that a court will decide the enforceability of the class-action waiver and the mass-arbitration provision below.
Fees. Drift Hockey will pay AAA filing, administrative, and arbitrator fees that exceed USD $200 for any individual consumer arbitration brought under these Terms, except where the arbitrator determines the claim was filed for an improper purpose, in which case fees may be reallocated under the AAA Rules and Federal Rule of Civil Procedure 11 standards.
Class-action waiver. You and Drift Hockey agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative proceeding.
Mass / coordinated filings. If 25 or more similar arbitration demands are filed against Drift Hockey by or with the assistance of the same law firm or coordinated group within a 60-day period, the parties agree to administer the demands under AAA's Mass Arbitration Supplementary Rules and a staged bellwether process. Court (not arbitrator) review governs this provision.
30-day opt-out. You may opt out of this Section 17 by emailing legal@drifthockey.com with the subject "Arbitration Opt-Out" and your full name and account email within 30 days of first accepting these Terms. Opting out will not affect any other terms.
Confidentiality. The parties will keep all aspects of the arbitration (including the existence of the proceeding, submissions, and any award) confidential, except as required to enforce an award, comply with law, or seek interim equitable relief.
Severability & survival. If the class-action waiver is held unenforceable as to a particular claim, that claim (and only that claim) will be severed and proceed in court; the rest of this Section 17 remains in effect. This Section 17 survives any termination of these Terms.
18. Marketing Communications
We may send you marketing emails about features, tips, and updates. Every marketing email includes a one-click unsubscribe link, and unsubscribing takes effect within 10 business days as required by the CAN-SPAM Act. Transactional and account-related messages (e.g., security alerts, billing receipts, notification preferences you have opted into) are not subject to unsubscribe.
19. Assumption of Risk — Athletic Activities
Drift Hockey is a coordination and communication platform for ice hockey, an inherently dangerous sport. The Service does not supervise, certify, coach, officiate, or guarantee the safety of any practice, game, tryout, off-ice training, travel, or other activity organized through it. Each User and each club assumes all risks associated with participation, including risk of serious injury or death. Clubs are solely responsible for player safety, supervision, certified-coach selection, background checks, medical clearance, equipment, liability waivers, and insurance. Drift Hockey LLC is not a party to any team's participation agreement.
20. No Medical, Coaching, or Officiating Advice
Content available through the Service — drills, practice plans, video commentary, statistics, and similar — is provided for informational purposes only. It is not, and is not a substitute for, professional medical, athletic-training, coaching, officiating, or legal advice. Users should consult qualified professionals before relying on any such content.
21. Photography, Video & Likeness
Coaches, parents, and club staff may upload photos and video that include the likenesses of players, including minors, for the legitimate purpose of team communication, instruction, and recordkeeping. By participating in a club's roster, you understand that such media may be captured and shared within the Service. If you object to a specific item, contact your club administrator first; Drift Hockey LLC will assist clubs in honoring removal requests as a data processor.
21a. Recording Consent — Two-Party-Consent Jurisdictions
Coaches, clubs, parents, and other Users who upload audio or video to the Service are solely responsible for obtaining all consents required by applicable wiretap, eavesdropping, recording-consent, biometric-information, or right-of-publicity laws before recording, capturing, or uploading any person's voice or likeness — including, without limitation, the all-party-consent statutes of California (Cal. Penal Code § 632), Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, New Hampshire, Oregon, Pennsylvania (18 Pa.C.S. § 5703), and Washington, and the Illinois Biometric Information Privacy Act (740 ILCS 14). The uploading User represents that all required consents have been obtained.
Drift Hockey LLC acts as a passive host of such media (see Section 8) and does not, and cannot, verify that the required consents have been obtained. The uploading User and the relevant club indemnify Drift Hockey LLC under Section 15 against any claim arising from a failure to obtain required consents.
22. Push Notifications
By enabling push notifications on a device, you consent to receive transactional and operational notifications (event updates, messages, billing, safety) on that device. You may disable any category at any time in Settings → Notifications, or revoke all push permission from your device OS settings.
23. Beta & Early-Access Features
We may make beta, preview, or early-access features available. These are provided "as is," may change or be removed without notice, and are excluded from any service-level commitments. If you submit feedback, you grant Drift Hockey LLC a perpetual, irrevocable, royalty-free, non-exclusive license to use that feedback for any purpose without obligation to you.
24. Apple App Store — Additional Terms
If you obtained the iOS app from the Apple App Store, the following additional terms apply, and in case of conflict with these Terms, control:
- This agreement is between you and Drift Hockey LLC only, not Apple, and Apple is not responsible for the app or its content.
- The license granted to you is a non-transferable license to use the app on Apple-branded products you own or control, as permitted by the App Store Terms.
- Apple has no obligation to provide any maintenance or support services for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
- Claims relating to the app's failure to conform to legal or regulatory requirements (including product-liability and consumer-protection claims) are the responsibility of Drift Hockey LLC, not Apple.
- You represent that (a) you are not located in a country subject to a US-Government embargo or designated as a "terrorist supporting" country, and (b) you are not on any US-Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
25. Google Play — Additional Terms
If you obtained the Android app from Google Play, you acknowledge that Google is not a party to these Terms, that the app is licensed (not sold) to you by Drift Hockey LLC, and that your use is also governed by the Google Play Terms of Service.
26. Force Majeure
Neither party is liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disaster, fire, flood, war, terrorism, civil unrest, labor disputes, governmental action, pandemic, internet or hosting-provider outage, or cyberattack.
27. Export Controls & Sanctions
You may not access or use the Service from any jurisdiction subject to comprehensive US sanctions or embargoes, and you may not be a person on the US Treasury Department's Specially Designated Nationals list, the US Commerce Department's Denied Persons list, or any equivalent list of any applicable government.
28. Account Inactivity
We may delete accounts that have not been signed into for at least 24 months. Before doing so, we will email the account address at least 30 days in advance so you can sign in to keep the account active.
28a. Deceased or Incapacitated Account Holders
If a User dies or becomes legally incapacitated, the surviving spouse, legal guardian, executor, or administrator of the estate may request closure of the account, or — where the deceased or incapacitated User was the verified parent of a managed child account — transfer of guardianship of that managed child account to another verified adult. Requests must be submitted by email to legal@drifthockey.com with subject "Estate Request" and must include (a) a certified death certificate or court-issued letters of administration, guardianship, or conservatorship, and (b) government-issued identification of the requester.
Except as required by court order, Drift Hockey LLC does not transfer access to private message history, photos, video, or other private content of the deceased or incapacitated User. We will respond to estate requests within 10 business days.
For managed child accounts: if no qualified parent or legal guardian comes forward within 90 days of our notice that the verified parent's account has been closed or is non-responsive, the managed child account is suspended and slated for deletion under the inactivity policy in Section 28.
29. U.S. Government End Users
The Service is "Commercial Computer Software" and the related documentation is "Commercial Computer Software Documentation," as those terms are defined in 48 C.F.R. § 2.101. Use, duplication, or disclosure by the US Government is subject to the restrictions in FAR 12.212 and DFARS 227.7202, as applicable.
30. Notices
We may give you notice through in-app messages, push notifications, or to the email address on your account, and notice is deemed given when sent. You must give us legal notice by email to legal@drifthockey.com with a copy by mail to Drift Hockey LLC, 521 Brookline Blvd, Havertown, PA 19083.
31. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted in-app and require you to re-accept before continuing to use the Service. Non-material changes take effect when posted. The "Effective" date at the top reflects the latest version.
32. Miscellaneous
These Terms, together with the Privacy Policy and Community Guidelines, are the entire agreement between you and Drift Hockey and supersede any prior agreement on the same subject. If any provision is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or asset sale.
33. Storage Reliability
The Service is not a backup service. You agree not to rely on it as the sole copy of any content important to you. We make commercially reasonable efforts to retain and protect content, but we are not liable to you or any third party for any modification, suspension, discontinuation, or loss of content. Export important rosters, schedules, and media regularly.
34. Sensitive Information Restriction
Clubs, coaches, and parents may not enter Social Security numbers, taxpayer IDs, drivers' license numbers, financial-account or payment-card numbers, government-issued identification numbers, precise geolocation, or genetic or biometric identifiers into roster fields, messages, notes, or any other free-text area. The Service is not designed to protect that data. If we determine that prohibited categories of information have been uploaded, we may delete it without notice and the uploading club is solely responsible for any breach-notification obligations that result.
35. California Release & Civil Code § 1542 Waiver
You release Drift Hockey LLC and its successors from claims, demands, losses, damages, rights, and actions of any kind — including for personal injury, death, and property damage — that arise from or relate to your use of the Service or any interaction between you and another user, whether on or off the Service. If you are a California resident, you expressly waive California Civil Code § 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
36. Accessibility
We design the Service with WCAG 2.1 AA as our accessibility target. If you encounter a barrier, or need an accommodation to access any part of the Service, email support@drifthockey.com with subject "Accessibility" and we will respond within 5 business days. We treat accessibility defects as bugs and prioritize them accordingly.
37. User-Generated Content Safety Controls (Apple App Review Guideline 1.2)
Consistent with Apple App Review Guideline 1.2 and equivalent Google Play UGC requirements, the Service provides:
- Filtering of objectionable material — automated keyword and pattern filtering on messages and uploads.
- User reporting — long-press any message or piece of user content to report it. Reports are queued for human review.
- User blocking — block another user from Settings → Blocked Users; blocked users cannot message you and their content is hidden.
- Direct contact for complaints safety@drifthockey.com — monitored by our safety team.
- 24-hour triage on all reports, and permanent ejection of users who violate our Community Guidelines, including device-fingerprint-aware suspension to deter ban-evasion accounts.
38. No Third-Party Beneficiaries
Except for Apple Inc. and its subsidiaries (which are third-party beneficiaries of Section 24 only), these Terms are solely for the benefit of you and Drift Hockey LLC. No other person or entity has any right to enforce them, and nothing in these Terms creates any agency, partnership, joint venture, employment, or fiduciary relationship between you andDrift Hockey LLC.
39. Anti-Circumvention (DMCA § 1201)
You may not circumvent, disable, or interfere with any technological measure that controls access to the Service or any portion of it, attempt to derive source code or underlying algorithms from the Service, or develop competing services using non-public information obtained from the Service. Violations may constitute a breach of these Terms and a violation of 17 U.S.C. § 1201.
39a. Coordinated Vulnerability Disclosure
Drift Hockey LLC welcomes good-faith security research. If you believe you have discovered a security vulnerability in the Service, please report it to security@drifthockey.com with sufficient detail to reproduce the issue. We will acknowledge your report within 5 business days and aim to remediate confirmed vulnerabilities within 90 days, after which coordinated public disclosure is appropriate.
Safe-harbor commitment. Drift Hockey LLCwill not pursue civil action or report you to law enforcement under the Computer Fraud and Abuse Act (18 U.S.C. § 1030), the Digital Millennium Copyright Act anti-circumvention provisions (17 U.S.C. § 1201), or analogous state laws for good-faith security research that complies with this Section, consistent with ISO/IEC 29147 and the U.S. Department of Justice "Framework for a Vulnerability Disclosure Program for Online Systems." To qualify, you must:
- only access, modify, or copy data to the minimum extent necessary to demonstrate the vulnerability, and never attempt to access another user's data;
- not degrade, disrupt, or interrupt the Service, and not perform denial-of-service or volumetric testing;
- not socially engineer, phish, or physically attack Drift Hockey LLC staff, contractors, or users;
- not publicly disclose the vulnerability before Drift Hockey LLC has had a reasonable opportunity to remediate (typically 90 days);
- comply with all applicable law.
This Section does not create a bug-bounty program or any obligation to pay compensation, and it does not authorize testing of third-party systems (including any sub-processor).
40. Open-Source & Third-Party Software
The Service includes open-source and third-party components, each licensed under its own terms. A current list of components and their licenses is available at /oss-notices. Where an open-source license conflicts with these Terms with respect to a specific component, the open-source license controls for that component only.
41. Section 230 — Interactive Computer Service
Drift Hockey LLC is an "interactive computer service" as defined in 47 U.S.C. § 230(f)(2). Under 47 U.S.C. § 230(c)(1), no provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider. Drift Hockey LLC accordingly is not the publisher or speaker of, and is not liable for, any User Content or other information provided through the Service by any user, club, or third party. Under 47 U.S.C. § 230(c)(2), Drift Hockey LLC is further immune from liability for any action voluntarily taken in good faith to restrict access to or availability of material it considers obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable, whether or not such material is constitutionally protected. Nothing in these Terms is intended to waive or limit any protection available under 47 U.S.C. § 230 or any analogous state or foreign law.
