Drift Hockey LLC respects the intellectual-property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), we will respond to properly submitted notices of claimed infringement and terminate the accounts of repeat infringers.
1. Designated Agent
Notices of claimed copyright infringement must be sent to our designated agent:
DMCA Agent, Drift Hockey LLC
521 Brookline Blvd, Havertown, PA 19083
Phone: 610-324-9299
Email: dmca@drifthockey.com
Drift Hockey LLC hosts User Content uploaded by its users and relies on the safe harbor of 17 U.S.C. § 512(c) for storage of material at the direction of users. Designated-agent registration with the U.S. Copyright Office (per 17 U.S.C. § 512(c)(2)) is in progress. Once registered, the directory entry will mirror the contact details above. Notices that do not comply with Section 2 may not be effective.
2. Notice of Claimed Infringement
To file a takedown notice, your written communication must include all of the following:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing, with information sufficient to locate it (e.g., a direct link or message ID).
- Your contact information (mailing address, telephone number, email address).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on behalf of the owner.
Knowingly making material misrepresentations in a takedown notice may subject you to liability under 17 U.S.C. § 512(f). The sworn-statement requirements above (good-faith belief and accuracy under penalty of perjury) are required by 17 U.S.C. § 512(c)(3) and cannot be waived; notices missing these statements will not be effective and we may decline to act on them.
3. Counter-Notice
If you believe content you posted was removed in error, you may submit a counter-notice to our designated agent that includes:
- Your physical or electronic signature.
- Identification of the removed material and its location before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal court for the district where you live (or, if outside the US, for any judicial district where Drift Hockey may be found), and that you will accept service of process from the person who provided the original takedown notice.
On receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the material.
4. How We Process Notices
Email is the preferred submission method. Mail is accepted at the agent address above. We aim to review properly submitted notices within 10 business days. When we remove or disable access to material in response to a notice, we notify the affected user with a redacted copy of the notice so they can decide whether to file a counter-notice under Section 3.
5. Repeat-Infringer Policy
Drift Hockey LLC maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We treat three or more substantiated infringement notices against the same account as a presumptive basis for permanent termination, subject to our review of the circumstances.
6. Trademark Complaints
For trademark complaints, send a written notice to dmca@drifthockey.com that includes:
- The trademark at issue, registration number (if any), and jurisdiction.
- The location of the allegedly infringing material in the Service.
- The basis for your claim (likelihood of confusion, dilution, etc.).
- Your contact information and a good-faith statement that the use is not authorized.
- Your physical or electronic signature.
7. Other IP Concerns
For non-copyright, non-trademark IP concerns (e.g., publicity rights, trade secrets), email dmca@drifthockey.com with a description of the issue and supporting documentation.
8. No Duty to Monitor
Consistent with 17 U.S.C. § 512(m) and 47 U.S.C. § 230, Drift Hockey LLC has no obligation to (a) monitor the Service or User Content, (b) affirmatively seek facts indicating infringing activity, or (c) access, remove, or disable access to material where doing so is prohibited by law. Drift Hockey LLC's ability — but not obligation — to take down material in response to a notice or in its discretion does not impose, and shall not be construed to impose, any duty to monitor or screen User Content.
